Govt to take call after Sen sends his fresh resignation letter today


Non-commital on whether impeachment proceedings in the Lok Sabha would be dropped against Justice Soumitra Sen, the government on Friday said it would be able to take a view on the issue only after it receives his resignation letter in proper form from Rashtrapati Bhawan.


Sen, who is to face impeachment proceedings on Monday in the Lok Sabha, sent his resignation letter to President Pratibha Patil on Thursday but uncertainty on the matter arose after it was discovered that the communication had been faxed and hence, not in proper form. Article 217 (1) (a) of the Constitution says that “a Judge may, by writing under his hand addressed to the President, resign his office”.
President Patil, official sources said, has forwarded the letter to the Department of Justice, drawing attention to relevent legal provisions in this regard — in this case that the letter is not in original and not signed in his own handwriting.
