New Delhi: The Delhi High Court today questioned the bail granted to former Telecom Minister A Raja's ex- private secretary RK Chandolia in the 2G case and asked the trial court for all records related to the decision.
The decision would have an impact on the bail application filed by former Telecom Secretary Siddhartha Behura, said Justice VK Shaali in a written order which has been sent to the Special CBI Court handling the trial.
Justice Shaali had granted bail to DMK MP Kanimozhi and four others on Monday and reserved his order on Mr Behura's bail plea yesterday. The six had moved the High Court challenging the Special CBI Court's November 3 order denying them bail.
Yesterday, Mr Chandolia became the 12th person to walk out of jail after Special Judge OP Saini granted him bail.
Taking cognizance of "media reports" on Mr Chandolia's bail, the High Court said it deemed it "just and proper to see the legality, propriety and correctness of the order".
"The decision on his application for grant of bail is going to have an impact on the bail application of Siddhartha Behura. Question arises as to whether the order of grant of bail was just, proper or arbitrary or unreasonable having regard to the facts of the case and the allegations made against him," the order said.
The High Court added that there would be a stay on Mr Chandolia's bail order in case he had not been released already. It asked for notices to be served on Mr Chandolia as well as the CBI.
His lawyers plan to approach the Supreme Court against this order on Monday.
Mr Chandolia was one of the three public servants arrested in the case, the others being Mr Raja and Mr Behura. Mr Raja has refused so far to apply for bail - he says he would prefer to demolish the case against him in court.
The former bureaucrat is on trial along with Mr Raja and 13 others for charges that range from criminal conspiracy to breach of trust by a public servant.
