Black money: No special investigation team for now

New Delhi:  Two judges of the Supreme Court have disagreed on whether a special committee should be set up  to supervise the government's efforts to bring back black money or undeclared income stored by Indians in foreign banks.

In July, the Supreme Court asked for a committee that would report to two retired judges and would include senior bureaucrats and the chief of RAW (Research and Analysis Wing), the agency which handles external intelligence.  The government had objected to the Supreme Court's order, accusing the court of "judicial over-reach."

Today, two judges hearing the case differed on whether the centre's appeal should be considered.  Justice Atmas Kabir said it should. Justice SS Nijjar disagreed and dismissed the government's petition.  The Chief Justice of India will now set up a larger bench to hear the case.

Till that happens, the Special Investigation Team will not be constituted.
